Under what circumstances need to change or extend work permit?

China has implemented an administrative permit system for foreigners to come to China for employment. As the number of foreigners coming to China for employment has increased in recent years, the legal issues related to foreigners coming to China for work have received more and more attention. Under what circumstances do I need to apply for a change or extension of my work permit?

I. Extension of Work Permit for Foreigners Coming to China

If the employer continues to employ the applicant in the original position (occupation), the employer shall submit an application to the decision-making authority 30 days before the expiry date of the applicant's work permit to China.

Material Requirements:

1、Application Form for Extension of Work Permit for Foreigners to China

2. Employment contract or certificate of employment

3. Visa or valid residence permit

4、Work Permit for Foreigners

Tips:

1、It is stipulated by laws and regulations of China that the approval shall be preceded by the competent authority of the industry, and the instrument of approval by the competent authority of the industry shall be provided.

2、In case of reappointment to a new post within the same organisation, including promotion from a professional post to an administrative post, a certificate of post change shall be submitted in case of extension.

3、In case of reappointment to a new post (occupation), a new application for work permit for foreigners to come to China shall be made.

(4) If the applicant applies for extension according to the category of foreign high-end talents (Class A), he/she shall submit the corresponding certificates and documents.

All original paper documents and Chinese translations shall be uploaded to the processing system electronically.

Change of Foreign Work Permit

If the applicant's personal information (name, passport number, position, category) and other matters are changed, the applicant shall submit an application to the permit decision authority within 10 working days from the date of change.

Material requirements:

1、Application Form for Change of Work Permit for Foreigners Coming to China

2. Applicant's passport number, passport information page and visa page.

If the applicant is reassigned to a new position within the same organisation, the applicant shall provide a letter of application for change and corresponding supporting documents.

4、If the applicant changes to a new occupation, he/she should cancel the existing work permit and reapply for a new work permit for foreigners to come to China.

Tips:

1. The applicant's passport (international travel document) number, the new passport (international travel document) number and information page and visa page shall be provided.

2. If the applicant is reappointed to a new position within the same organisation, including promotion from a professional position to an administrative position, the applicant shall provide a letter of application for the change and the corresponding supporting documents, or the national laws and regulations shall stipulate otherwise.

3. In case of changing to a new post (occupation), the existing work permit shall be cancelled and a new application shall be made for a work permit for foreigners to come to China.

4. All original paper documents and Chinese translations shall be uploaded to the processing system in electronic form.
